Terms of Sale and Terms of Use

1. Purpose

These Terms of Sale and Terms of Use ("Terms") govern access to and use of the omyria.ch website (the "Site"), as well as the conditions under which OMYRIA provides its real estate brokerage and advisory services.

2. Terms of Use of the Site

Access to the Site is free of charge. Users agree not to use the Site for fraudulent purposes or in a manner contrary to public order, and not to interfere with its operation or security.

Information relating to properties presented on the Site is provided for indicative purposes only and does not constitute a firm offer or contractual commitment on the part of OMYRIA.

3. Terms of Sale for Services

Any mandate entrusted to OMYRIA (purchase, sale, advisory or Off Market mandate) is subject to a prior agreement, formalised separately, specifying the scope of the mandate, financial terms and termination conditions.

These Terms do not replace such a written mandate but complement the general framework for using the Site.

4. Forms & Contact Requests

By submitting the Site's contact form, users authorise OMYRIA to store and process the personal data submitted, in order to provide the requested content or response, in accordance with our GDPR / FADP policy.

5. Fees

Fees applicable to OMYRIA's brokerage services are communicated individually to each client prior to the conclusion of any mandate, and are in line with standard practice in the Swiss prestige real estate sector.

6. Liability

OMYRIA undertakes to carry out its mandates with diligence and professionalism. Its liability cannot be engaged in cases of force majeure, incorrect information provided by the client or a third party, or circumstances beyond its reasonable control.

7. Amendments to These Terms

OMYRIA reserves the right to amend these Terms at any time. The applicable version is the one in force on the date the Site is consulted.

8. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the Canton of Valais, subject to mandatory legal provisions to the contrary.
